Terms of Service

1. Scope of Services
GrowthMarketLab provides growth hacking, market research, consumer behavioral analytics, conversion optimization, and strategic consulting services. The specific scope, deliverables, and timeline for each engagement are defined in a written proposal or statement of work (SOW) agreed upon by both parties.
2. Engagement Terms
All engagements begin upon receipt of signed agreement and initial payment. Work timelines commence on the date specified in the SOW. Client is responsible for providing timely access to necessary data, platforms, and personnel as outlined in the project brief.
3. Payment Terms
Invoices are due within 14 days of issue unless otherwise specified in the SOW. Late payments incur a statutory interest rate of 9 percentage points above the ECB base rate per Art. 288 BGB. GrowthMarketLab reserves the right to suspend services for accounts more than 30 days overdue.
4. Intellectual Property
Upon full payment, all deliverables and work product created specifically for the Client under a SOW are assigned to the Client. GrowthMarketLab retains ownership of pre-existing methodologies, frameworks, tools, and general know-how. Confidential information shared by either party remains protected under the confidentiality provisions below.
5. Confidentiality
Both parties agree to maintain strict confidentiality regarding proprietary information, business strategies, data, and methodologies shared during the engagement. This obligation survives termination for a period of 24 months.
6. Limitation of Liability
GrowthMarketLab's total liability shall not exceed the total fees paid by the Client for the specific engagement giving rise to the claim. We are not liable for indirect, consequential, or incidental damages. Growth outcomes are influenced by numerous external factors; while we employ best practices and data-driven methodologies, specific revenue or growth results are not guaranteed.
7. Termination
Either party may terminate an engagement with 14 days' written notice. In case of termination, Client is responsible for payment of all work completed up to the termination date. Sections on confidentiality, intellectual property, and limitation of liability survive termination.
8. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be submitted to the exclusive jurisdiction of the courts in Essen, Germany.
Refund Policy
GrowthMarketLab, Am Deimelsberg 30, 45276 Essen, Germany, stands behind the quality of our growth hacking and market research services. This refund policy outlines the conditions under which refunds may be issued.
1. Project-Based Refunds
For fixed-price engagements, refunds are evaluated based on project milestones completed. If a project is terminated before the first deliverable milestone, a full refund minus any administrative fees (up to 10% of the project value) may be issued. Work completed up to the point of termination will be compensated proportionally.
2. Subscription and Retainer Refunds
Monthly retainer agreements may be cancelled with 14 days' notice before the next billing cycle. Pre-paid months that have not commenced are refundable in full. Active service months are non-refundable but all completed deliverables will be delivered to the Client.
3. Sprint and Workshop Refunds
Growth Experimentation Sprints and strategy workshops may be rescheduled up to 5 business days before the start date at no charge. Cancellations within 5 business days of the start date are non-refundable due to resource allocation commitments.
4. Deliverable Quality
If deliverables do not meet the specifications agreed upon in the SOW, GrowthMarketLab will revise the work at no additional charge within 14 days of feedback. If revision does not resolve the issue, a proportional refund may be negotiated in good faith.
5. Growth Outcome Disclaimer
While GrowthMarketLab employs data-driven methodologies and industry best practices, specific growth metrics, revenue targets, or market outcomes are influenced by numerous external factors beyond our control. Refund requests based solely on unmet growth projections (where deliverables were completed per SOW) are evaluated on a case-by-case basis.
6. Refund Process
Refund requests must be submitted in writing to [email protected] within 30 days of the event giving rise to the request. Approved refunds are processed within 14 business days to the original payment method. EU consumers may also exercise their statutory right of withdrawal within 14 days of contract conclusion as per § 355 BGB.
7. Dispute Resolution
In the event of a dispute regarding refunds, both parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes shall be submitted to mediation before initiating formal proceedings in the courts of Essen, Germany.
